Alioto City Tours – Terms & Conditions

These Terms & Conditions apply to reservations and services provided by Alioto City Tours LLC (“Alioto City Tours,” “we,” “us,” or “our”).

By purchasing a ticket, making a reservation, or participating in a tour or private charter operated by Alioto City Tours, you acknowledge that you have read, understood, and agree to these Terms & Conditions.

​

If you make a reservation on behalf of other guests, you are responsible for communicating these Terms & Conditions to your party and, where Alioto City Tours provides you with a Release of Liability signing link for distribution, for providing that link to the applicable guests. 
 

1. Reservations and Payment

Reservations are subject to availability and are not confirmed until payment has been successfully processed and a booking confirmation has been issued.

All prices are listed in U.S. dollars and may be subject to applicable taxes, fees, or other charges disclosed at checkout.

​

Guests are responsible for providing accurate contact information when making a reservation so that Alioto City Tours can communicate important information regarding the booking.

​

2. Public Sightseeing Tour Cancellation & Rescheduling Policy

Reservations for public sightseeing tours canceled at least 24 hours before the scheduled departure time are eligible for a full refund to the original form of payment.

​

Reservations canceled less than 24 hours before the scheduled departure time are non-refundable.

If your plans change, you may request one complimentary reschedule, subject to availability.
 

Once a reservation has been moved using the complimentary reschedule, the reservation becomes non-refundable, including if the new tour date is more than 24 hours away.
 

A courtesy reschedule must be requested before the originally scheduled tour departure time and is not available to guests who have already been classified as a no-show.

3. Release of Liability

Every guest is asked to sign a Release of Liability, Waiver of Claims, and Assumption of Risk (“Release” or “Release of Liability”) before participating in a tour. No guest is required to sign it; however, a guest who does not sign may not participate.
 

Alioto City Tours will send a signing link after a reservation is made to each adult guest, and to the parent or legal guardian of each guest under 18. The Release may also be signed at the vehicle before departure.
 

A guest who chooses not to sign will be refunded in full for a public tour, regardless of the cancellation timing described in Section 2; for a private charter, refunds are governed by the Private Charter Agreement. If the Release and these Terms & Conditions conflict on release, waiver, or assumption of risk, the Release controls.

4. No-Shows and Late Arrivals

Guests should arrive at the designated pickup location at least 15 minutes before the scheduled departure time.


Tours operate on a schedule and may depart at the scheduled time without guests who have not arrived.
 

Guests who miss their scheduled departure without contacting Alioto City Tours before departure will be considered a no-show.
 

No-shows are not eligible for a refund or courtesy reschedule.
 

Alioto City Tours is not responsible for a guest's late arrival resulting from traffic, public transportation delays, parking difficulties, rideshare delays, flight delays, or other circumstances outside Alioto City Tours' control.

5. Cancellations by Alioto City Tours

Alioto City Tours reserves the right to cancel a tour when reasonably necessary due to unsafe conditions, severe weather, mechanical problems, road closures, government restrictions, emergencies, or other circumstances that prevent the tour from being safely or reasonably operated.
 

If Alioto City Tours cancels a tour and cannot provide a reasonable alternative or rescheduled tour, guests will receive a full refund of the amount paid to Alioto City Tours for the affected reservation.
 

Alioto City Tours is not responsible for incidental or consequential expenses associated with a canceled tour, including airfare, lodging, meals, parking, transportation, or other travel expenses, except where otherwise required by law.

6. Tour Routes, Stops and Itineraries

Tour routes, stops, attractions, schedules, and durations are subject to change.
 

San Francisco and the surrounding Bay Area may experience traffic, road closures, construction, special events, demonstrations, weather conditions, government activity, or other circumstances that affect access to particular locations.
 

Alioto City Tours may reasonably modify, substitute, reorder, shorten, or omit stops when necessary due to safety concerns, traffic, timing, accessibility, closures, weather, or circumstances outside our reasonable control.

Return and arrival times are estimates and are not guaranteed.
 

Reasonable modifications to an itinerary do not automatically entitle a guest to a refund.

7. Passenger Conduct and Safety

The safety and comfort of our guests are important to us.
 

Guests must comply with reasonable instructions provided by the driver or tour guide and with applicable laws and safety requirements.
 

Guests must remain properly seated while the vehicle is moving and use available seat belts as required by law or instructed by the driver.
 

Unsafe, threatening, abusive, disruptive, harassing, destructive, or illegal behavior will not be tolerated.
 

Alioto City Tours reserves the right to refuse service or remove a guest from a tour when reasonably necessary to protect the safety or comfort of passengers, employees, the public, or property.
 

Guests who are refused service or removed because of their conduct are not entitled to a refund.

8. Alcohol, Smoking, Vaping and Controlled Substances

Alcohol may not be brought aboard or consumed in Alioto City Tours vehicles.
 

Alioto City Tours does not provide, sell, serve, or furnish alcoholic beverages as part of its tours or charter services.
 

Smoking and vaping are prohibited in Alioto City Tours vehicles.
 

The possession or use of illegal drugs is prohibited.
 

Guests who violate these rules may be refused boarding or removed from the tour and may not be entitled to a refund.

9. Boarding and Exiting the Vehicle

Guests are responsible for exercising reasonable care while boarding and exiting the vehicle.
 

Guests should follow instructions from the driver or guide regarding safe boarding and exiting and should not attempt to enter or exit the vehicle until it is safe to do so.
 

Guests should notify Alioto City Tours before the tour if they require assistance or an accommodation when entering or exiting the vehicle.

10. Tour Stops and Walking

Sightseeing tours may involve walking and visiting public locations that Alioto City Tours does not own or control.
 

Tour stops may include sidewalks, curbs, stairs, hills, uneven pavement or terrain, crowds, wet or slippery surfaces, and exposure to changing weather conditions.
 

Guests should wear appropriate footwear and clothing and consider their own ability to participate comfortably and safely.
 

Guests are responsible for exercising reasonable care while participating in activities away from the vehicle.

11. Children and Minors

Guests must be at least 5 years old. Children who require a car seat or booster seat must bring their own appropriate restraint. A parent or legal guardian must install and secure the restraint and ensure the child is properly buckled before departure.
 

Children must be accompanied and appropriately supervised by a responsible adult.

​

Parents and guardians are responsible for determining whether a tour is appropriate for their child.

​

Parents and guardians are also responsible for complying with applicable child passenger restraint and safety requirements.

​

Guests traveling with young children should contact Alioto City Tours before booking if they have questions regarding child safety seats, restraints, or other accommodations.

​

For each guest under 18 years of age, the Release described in Section 3 is signed by a parent or legal guardian. A teacher, chaperone, or other adult who is not the child’s parent or legal guardian cannot sign on a child’s behalf.

​

12. Accessibility and Special Accommodations

Guests requiring accessibility accommodations or assistance are encouraged to contact Alioto City Tours before booking.

​

We will make reasonable efforts to accommodate guests where practicable and as required by applicable law.

​

Providing advance notice allows us to better determine whether and how a requested accommodation can be provided.

​

13. Personal Belongings

Guests are responsible for their personal belongings during the tour.

​

Alioto City Tours is not responsible for lost, stolen, misplaced, forgotten, or damaged personal property except to the extent responsibility cannot legally be excluded.

​

If an item is left behind, we will make reasonable efforts to locate and return it, but recovery cannot be guaranteed.

Guests may be responsible for reasonable shipping or delivery expenses associated with returning lost property.

​

14. Communications and Text Messages

Alioto City Tours will send booking confirmations and information about your tour, including messages on the day of the tour regarding pickup location and timing. These communications are part of your reservation.

​

Guests may separately choose to receive marketing emails and text messages. Consent to marketing messages is optional, is not required in order to book, and may be withdrawn at any time by following the unsubscribe instructions in the message or by contacting Alioto City Tours. Message and data rates may apply. See the Alioto City Tours Privacy Policy for details of how personal information is collected and used.

15. Third-Party Locations and Services

Tours may visit, stop at, or pass through locations owned, operated, maintained, or controlled by third parties, businesses, municipalities, government agencies, or other organizations.

​

Alioto City Tours does not control the operation, condition, availability, admission policies, hours, safety practices, or conduct of independent third-party businesses, attractions, facilities, or public spaces.

​

Alioto City Tours is not responsible for closures or changes imposed by third parties that are outside our reasonable control.

​

Where a reservation includes services provided by a third party, additional terms imposed by that provider may apply.

​

16. Weather

Tours generally operate in typical San Francisco and Bay Area weather conditions, including fog, light rain, wind, and changing temperatures.

​

Weather that a guest personally considers undesirable does not automatically entitle the guest to cancel outside the standard cancellation policy.

​

Alioto City Tours will determine whether weather or other conditions make operating a tour unsafe or impracticable.

​

If Alioto City Tours cancels a tour due to unsafe conditions, the cancellation provisions in Section 5 will apply.

​

17. Private Tours and Charters

Private tours and charters are booked under a separate Private Charter Agreement, which governs pricing, deposits, cancellation, overtime, itinerary, and related terms. If a Private Charter Agreement conflicts with these Terms & Conditions with respect to a private charter, the Private Charter Agreement controls, except that the Release controls as to release, waiver, and assumption of risk. The person arranging a charter agrees to provide guest names and email addresses to Alioto City Tours and to assist in obtaining a signed Release from each guest.

18. Photography and Recording

Guests may take photographs and personal video during tours where doing so is permitted and does not interfere with the safety or enjoyment of other guests.

​

Alioto City Tours uses photographs and video of its tours for promotional purposes only where the guests appearing in them have given consent. Consent is requested separately before the tour begins and is not a condition of participation.

​

19. Limitation of Liability

Except for claims of personal injury or death, which are addressed in the Release described in Section 3, the total liability of Alioto City Tours for any claim arising out of or relating to a reservation or these Terms & Conditions is limited to the amount paid to Alioto City Tours for the affected reservation, and Alioto City Tours will not be responsible for indirect, incidental, special, or consequential losses. This Section does not apply to fraud, gross negligence, or willful misconduct.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

​

20. Circumstances Beyond Our Control

Alioto City Tours will not be responsible for a failure or delay in providing services caused by circumstances beyond its reasonable control, including severe weather, natural disasters, fires, road closures, government actions, civil emergencies, strikes, major transportation disruptions, or similar events.

​

When reasonably possible, Alioto City Tours will attempt to provide an alternative itinerary, reschedule the affected service, or provide an appropriate refund or credit.

​

21. Governing Law

These Terms & Conditions and reservations made with Alioto City Tours are governed by applicable laws of the State of California.

​

Any claim that is not subject to arbitration under Section 22 must be brought in the state or federal courts located in San Francisco County, California.

​

22. Dispute Resolution: Arbitration and Class Action Waiver

Please read this Section carefully. It affects how disputes between you and Alioto City Tours are resolved.

(a) Informal resolution first. Before starting a formal proceeding, please send Alioto City Tours a written description of the dispute and what you would like done about it, by email to info@aliotocitytours.com or by mail to 2027 Taraval Street, San Francisco, California 94116. Alioto City Tours will do the same. If the dispute is not resolved within 60 days, either party may proceed under this Section. Any applicable limitations period is tolled while this informal process is under way.

​

(b) Individual arbitration. Except as stated below, any dispute arising out of or relating to these Terms & Conditions, a reservation, or a tour will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures and subject to the JAMS Consumer Arbitration Minimum Standards, and not in court. This Section does not apply to any claim that applicable law does not permit to be resolved by arbitration.

(c) Small claims. Either party may instead bring an individual claim in small claims court if the claim qualifies for that court.

(d) Class action waiver. Claims may be brought only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any class or representative proceeding.

​

(e) Public injunctive relief. This Section does not waive any right to seek public injunctive relief. A claim for public injunctive relief must be brought in court, and proceedings on that claim are stayed until the arbitration is complete.

​

(f) If the class action waiver is unenforceable. If subsection (d) is found unenforceable as to a particular claim, that claim must proceed in court, and the remainder of this Section continues to apply to all other claims.

​

(g) Opt out. You may opt out of this Section by emailing info@aliotocitytours.com within 30 days after first accepting these Terms & Conditions, stating your name and that you are opting out of arbitration. Opting out does not affect any other part of these Terms & Conditions and will not affect your reservation.

​

23. General

If any provision of these Terms & Conditions is held unenforceable, the remaining provisions remain in effect and the unenforceable provision is enforced to the greatest extent allowed. A failure to enforce any provision is not a waiver of that provision. You may not transfer your rights under these Terms & Conditions without the consent of Alioto City Tours; Alioto City Tours may transfer its rights in connection with a sale or reorganization of its business. These Terms & Conditions, together with the Release and, for private charters, the applicable Private Charter Agreement, are the entire agreement between you and Alioto City Tours concerning the subjects they cover.

24. Changes to These Terms

Alioto City Tours may update these Terms & Conditions from time to time.

​

The Terms & Conditions applicable to a reservation are those presented or made available to the customer in connection with that booking.
